Terms and conditions
To contract activities with our company, you must agree to these terms, rules, and clauses. They are detailed below in the following sections:

It is mandatory to have read and accepted them before making the reservation payment; considering such payment as confirmation of having read and accepted them. Marbella Adventures commits to providing them via their website, before you make the payment. Non-compliance with these considerations, rules, and clauses may result in the suspension of the activity.
1. ESSENTIAL CONSIDERATIONS
1.1 – INSURANCE
Marbella Adventures maintains all mandatory insurances required by law for active tourism.
Professional Civil Liability: Iberian Insurance Company (Policy: LLO2023000206).
Collective Accident Insurance: Cervera Asesores Correduría de Seguros S.L. (Policy: 0114793).
1.2 – ASSUMPTION OF RISK
By booking, the client acknowledges that “Active Tourism” and outdoor activities (such as canyoning, hiking, and water sports) involve inherent risks including, but not limited to: slippery terrain, moving water, changing weather, and wildlife. The client voluntarily assumes these risks and agrees to follow all safety instructions provided by the guides.
1.3 – AUTHORITY OF GUIDES
The authority of the guides is final regarding safety decisions. Disrespect towards staff, other clients, or the natural environment will not be tolerated. We reserve the right to exclude any participant whose behaviour endangers the group without a refund.
1.4 – EQUIPMENT RESPONSIBILITY
We provide specialized safety equipment. The client is responsible for the gear assigned to them. In the event of loss or damage due to negligence (e.g., losing a rented camera or damaging gear through improper use), the client may be charged for the repair or replacement cost.
1.5 - IMAGE RIGHTS
The client authorizes Marbella Adventures to take photographs or videos during the activity for promotional and marketing purposes. If you do not wish to appear in promotional material, please inform us in writing or notify your guide before the activity begins.
2º - RESERVATION AND CANCELLATIONS
2.1 - GROUP LEADER RESPONSIBILITY
The person making the booking (the "Contracting Party") guarantees they have the authority to accept these terms on behalf of all participants in their group and is responsible for communicating these conditions to all members.
2.2 - STANDARD CANCELLATION
Cancellations are permitted free of charge up to 24 hours prior to the scheduled activity. Cancellations made within 24 hours of the activity start time, or failure to attend without prior notice, will not be eligible for a refund or rescheduling. These policies are strictly enforced, and exceptions cannot be made regardless of the reason for cancellation.
2.3 - LARGE GROUP CANCELLATION
For group bookings exceeding 25 participants, a separate cancellation policy applies due to the additional preparation, staffing, and equipment allocation required for large events.

More than 30 days prior to the activity: Full refund, minus a 5% administration and transaction fee.

14 to 30 days prior to the activity: 75% refund.

7 to 13 days prior to the activity: 50% refund.

Less than 7 days prior to the activity: No refund will be provided.
2.4 - FORCE MAJEURE
Marbella Adventures reserves the right to cancel or postpone activities due to circumstances beyond our control, including logistical issues, extreme weather, dangerous water levels, road closures, or government-mandated park closures. If cancellation occurs before the activity starts, customers will be offered a full refund or the option to reschedule.
3º - HEALTH AND SAFETY REQUIREMENTS
3.1 - MEDICAL DISCLOSURE
Participants must be in good health. It is mandatory to disclose any pre-existing medical conditions that could be affected by physical exertion, including: asthma, heart conditions, pregnancy, epilepsy, or severe allergies (e.g., bee stings).
3.2 - SUBSTANCE USE
Participants must not be under the influence of alcohol, drugs, or any medication that impairs reaction time or physical ability.
4º - LEGAL COMPLIANCE AND JURISDICTION
4.1 - COMPLAINT FORMS
In accordance with Decree 171/1989 of the Junta de Andalucía, official complaint forms (Hojas de Reclamaciones) are available to consumers and users upon request.
4.2 - GOVERNING LAW
These conditions are governed by Spanish law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Marbella/Málaga.
4.3 - SEVERABILITY
If any part of these terms is found to be invalid by a court, the remaining sections shall remain in full force and effect.
