Terms and conditions

To contract activities with our company, you must agree to these terms, rules, and clauses. They are detailed below in the following sections:

It is mandatory to have read and accepted them before making the reservation payment; considering such payment as confirmation of having read and accepted them. Marbella Adventures commits to providing them via their website, before you make the payment. Non-compliance with these considerations, rules, and clauses may result in the suspension of the activity.

 

1 – CONSIDERATIONS TO BEAR IN MIND

1.1 – INSURANCE

Marbella Adventures has the mandatory insurances required by law to carry out sports activities. We have the following insurances:

1.2 – AUTHORITY OF GUIDES AND DISRESPECT

The authority and professionalism of the guides will never be questioned or doubted by any of the clients in terms of their ability to make decisions affecting the client or the group. Disrespect towards the guide, other clients, or people from other groups carrying out the activity or in the same natural environment will not be tolerated.


1.3 – CLIENT'S HEALTH REQUIREMENTS

The client acknowledges not having any physical, mental, or prior health problems before the activity. In case of suffering from any ailment, illness, previous injury, taking medication or being pregnant, they must inform the company so that their ability to carry out the activity can be assessed, actions can be anticipated, or the activity can be dismissed.

Under no circumstances will the company be held responsible for illnesses or injuries prior to the activity.

The client acknowledges not having consumed narcotics, drugs, or alcohol and being in good physical condition. The guide may cancel the activity if the client is under the influence of drugs or alcohol. If the client, either voluntarily or due to ignorance of the activity, lack of physical fitness, or not being in optimal conditions for the development of the activity, is excluded from it, no money will be refunded in any case for such activity.


1.4 – BEHAVIOR RULES

The client will accept the behavior rules and prohibitions of the various regulations in force in the different natural or national spaces where the activities take place. Similarly, they will accept the measures taken by the guide in the different activities regarding the conservation of the environment in which they are carried out.
Some of the rules and measures taken for environmental conservation are: not throwing garbage or organic waste; walking on trails and paths; not picking up plants, animals, or rocks; not disturbing or shouting in bird nesting areas; not drawing or painting on walls, rocks, information panels, etc.; not breaking, scratching, or damaging furniture or signage. Other more specific behavior rules will be indicated by the guide in each specific situation.


1.5 - PROPER TREATMENT AND LOSS OF MATERIAL

The company's equipment is continuously checked and in good condition for use. Therefore, from the moment of delivery until its return, the client is responsible for it and must return it in perfect condition. In case of loss or damage due to misuse of the material, payment for it may be required.
Marbella Adventures will not be responsible for the loss or damage of personal belongings that the client brings to the activity.


1.6 - TRANSPORT AND PUNCTUALITY

For the realization of the activity, the client will use their own transportation to get to the meeting point. The company will not be responsible for accidents or incidents that clients may have with (their) vehicles during the trip to, parking at, or return from the activity.
The client must be present at the meeting point 15 minutes before the start of the tour. If the client is delayed and not present at the starting time of the tour, the company reserves the right to leave the meeting point and no refund will be given for the contracted activity.


1.7 - CHANGE OF ACTIVITIES

Marbella Adventures reserves the right to partially or fully cancel activities due to weather conditions or organizational reasons. The company always holds the final decision on suspending any activity for safety reasons.


1.8 - CLAIMS

In order to quickly and correctly address clients' claims, they must be made at the end of the activity. Marbella Adventures can provide the client with a complaints form if requested.


1.9 - MINORS

All contractors admit to being of legal age. In the case of being a minor and not being accompanied by their father, mother, or legal guardian, they must always be authorized through the appropriate authorization. Marbella Adventures does not accept minors in their activities without at least one adult legal guardian present in the activity. Children younger than 8 can also not be accepted for the activity.


1.10 - PHOTO REPORT

During the activities, Marbella Adventures may take photographs or videos which may be used for commercial and advertising purposes. This will always be with the utmost respect for the client and their image.


2º - RESERVATION AND CANCELLATION CONDITIONS


2.1 - HOW IS A RESERVATION MADE?

To make a reservation for any activity, you must pay the total price of the program in advance. The reservation will be effective upon receipt of payment or proof of payment.
From the confirmation of the reservation, the client expressly assumes all of these Legal Conditions. The contracting party assumes responsibility for communicating these conditions in case they sign up other people for the activity.


2.2 - CANCELLATION OF A RESERVATION PRIOR TO THE ACTIVITY

Clients can cancel free of charge up to one week before the tour date. If clients cancel within this week and up to 48 hours prior to the tour, the client will be eligible for a refund of 50% of the total order amount. If a client cancels within 48 hours of the tour, no refund will be provided. In case of adverse weather conditions on the day of the activity, Marbella Adventures might have to cancel the tour due to safety reasons. However, in this case the client will be fully refunded and Marbella Adventures will make every effort to reschedule.


2.3 - CANCELLATION DURING THE ACTIVITY
2.3.1 - BY THE CLIENT OR CAUSED BY THE CLIENT

In none of the following cases will the money be returned to the client:

  • If the client decides to quit voluntarily.

  • If the client turns out to be below the minimum age.

  • Due to the client's lack of physical fitness.

  • Due to the client's lack of knowledge of the activity.

  • If the client is not in optimal conditions for the proper development of the activity.

  • For not adhering to these Legal Conditions of the company, which the client has admitted to reading and accepting.


2.3.2 - BY THE COMPANY

In case of having to suspend the activity and not being able to replace it with another of a similar nature due to adverse weather, adverse climatology, adverse hydraulic flows, or motivated by safety, the activity will be postponed or cancelled in agreement with the client. In this case, the client will receive a full refund.
If an activity is suspended once started for safety reasons, accidents, weather changes, climatic or hydraulic changes, the amount will not be refunded.


3º - MANDATORY REQUIREMENTS FOR THE ACTIVITY

  • You must be mobile and able to manoeuvre yourself through rocky areas while using your hands and feet

  • You must be able to swim well independently

  • Participants must be 8 years or older
